Gabriel, Halle And Olivier Are All Playing Nice Now
Gabriel Aubry doesn't have to wear a steel face mask and an iron helmet when he goes to pick up his daughter Nahla at Halle Berry's house, because Olivier Martinez won't be there to pound the pretty out of his face. Gabriel's lawyer Shawn Holley (yeah, that Shawn Holley) and Halle's lawyer Blair Berk met in court today and came up with "amicable settlement," so that the judge doesn't have to declare all of them legally insane and give full custody to Jessica Lange or a pack of lions.
Halle isn't going to try to extend the restraining order she has out against Gabriel and he gets to visit Nahla again like normal. Shawn Holley and Blair Berk didn't give any details about the settlement, but a source (aka Gabriel using a voice changer) tells Radar that Halle agreed to keep Olivier away from the house whenever Gabriel comes to pick their daughter up. Gabriel is totally scared of Olivier and he's afraid that if they run into each other again, Olivier is going to beat Gabriel's pretty model face so hard that it's going to permanently look like Olivier's present day face. The source went on to say, "This was very important to Gabe going forward because he feared for his safety. Gabe was supposed to have Nahla on Thanksgiving, according to their custody agreement, but Halle asked if she could have the little girl that day and Gabe said yes. He had no obligation to do so, but he had been acting in good faith and knew it meant a lot to Halle, so he did it. Gabe was absolutely blindsided by Olivier and his rage."
So they're all going to join hands and skip through the lavender fields under a double rainbow....until Halle and Olivier eventually break up and she gets herself a piece who's even crazier than him (I'm thinking Sean Penn). Then Halle and Gabriel will do this all over again. Gabriel should keep that steel mask and take self-defense classes from Bas Rutten just in case.

Okay, my two cents, I haven't read past page one, or well, I haven't even read page one of the comments, so it may have already been said: First I though that Gabriel is completely nuts for hitting Martinez. Then it became clear that Martinez was the one who did the punching and that this all was a set up by Berry and Martinez.
Why on earth didn't Gabriel try to get full custody? This tragedy will most likely never end - and what for? So their daughter thinks she needs heroin to be able to deal with her messed up childhood? Halle Berry for Mother of the year!

It certainly makes you wonder if this was all a set-up for Olivier to beat the crap out of Gabriel. It sounds like Gabriel walked right into their little plan by bringing the daughter back early, per Halle's request, for the holiday. I also agree that Olivier had no reason to beat Gabriel as badly as he did. It was overkill to pound the guy's face like that. Halle should have NEVER let Olivier be around when the kid was coming and going in the 1st place, especially when she knew tensions were high between the 2 men. Stupid to subject your child to that sort of thing.

But the more I think about it, she probably took it from the police report because it was a closed door hearing. She did say that it had been determined IN COURT that Gabe instigated the fight. You're right elmo.......how quickly she got "Gabriel Arrested" to TMZ on the Holiday and then to the rest of the media by way of TMZ says EVERYthing. The fact that the police refused to arrest Gabriel on the scene, so Le Squintnez had to do it himself again says EVERYthing. They wanted to paint him as the shit disturber. He let his guard down. Gabriel's "side" was only made public through obtaining legal docs when it was business as usual after the long holiday weekend.

I don't think it was "determined" at all that Gabriel instigated a fight. It is Le Squintez words vs. the evidence all over Gabriel's ribs and face. According to police reports, Gabriel was pleading with police to get video surveillance to prove that he didn't instigate.
He didn't instigate, but if he did, there was obviously still excessive force and threats.
