Nick Hogan Gets 8 Months In County Jail
Nick Bollea aka Nick Hogan was sentenced to 8 months in county jail starting immediately. 17-year-old Nick pleaded "no contest" on charges of felony reckless driving. The charges stem from a car crash last August which left his passenger and friend, John Graziano, with serious brain injuries. Nick was racing another car at speeds up to 100mph when his car hit a palm tree. A few hours later, booze was found in his bloodstream.
John will most likely spend the rest of his life in a nursing home.
The judge also suspended his drivers license for 3 years. He was also given 5 years probation, 500 hours of community service and he cannot drink during his probation. He will have to complete a booze education program within the year.
The judge heard statements from the Graziano family as well as the Bollea family. Brooke's stupid ass got up there looking like a call girl on her lunch break, crying about how "this is why she hates being a celebrity." It's all about her!
Before being sentenced, Nick told the judge, "I'll never, ever be able to tell John 'sorry' enough times to make up for what happened on Aug. 26. I loved John to death. He was like my oldest brother and my best friend. I'm ready to take my punishment."
I hope he's ready to take big cock too, because that's what he's going to have to do in jail. If you ask me, this dumb whore got off easy.

Chris E - That was Vince Neil from Motley Crue. As someone who works in the justice system, 8 months is actually a pretty heavy sentence, particularly in motor vehicle cases. Weird, but true. The harshest sentence I ever saw for Motor Vehicle Homicide was 10 years, with 5 suspended.

This has nothing to do with celeb kids/douche bags etc..
It's a simple case of two friends out in their car, deciding to have a little race, they crashed, one didn't put on his seatbelt and paid the price.
I am sure they have been out numerous times going faster than they should have and nothing happened. But speed, alcohol and inexperience behind the wheel do not mix. In fact.. just the alcohol alone fucks you up for something that requires absolute concentration.
I am quite sure that he feels like absolute shit about things. Beyond this in fact. Realizing that you have effectively ended the life of your friend is something you wouldn't wish on anyone. No prison term is going to change anything at all. The fact that his friend is pretty much fucked will do more to straighten him out than anything else. If not, there is little you can do/say to change someone like this.

You are right, it doesn't lessen the offense at all... and I never said it did. I believe in causation, and whether or not the other kid wore a seat belt would not have changed the fact that Nick crashed.

But, I think adding the realities(probable ones anyway) of the incident to this discussion provides a more complete picture of what happened.
If anything its a grave lesson to anyone who is considering getting into a car under those circumstances without a seatbelt... but of course, if John got onto the car without knowing at all that Nick was drunk and Nick just decided on a whim to drag race then that makes Nick even more of an asshole. (on a purely speculative level, I find it hard to believe that John didn't know both or either of those things, but that's just me)

I feel the need to repeat what I said a long time ago on this thread....
First off, Nick wasn't 'very drunk'. Of course, at his age, he shouldn't be drinking at all, but his BAC was .05. Secondly, we have no idea if John Graziano, who, in all I read, never saw anything say that he was also drinking, knew that Nick was an habitual speeder, nevermind that he knew Nick was going to drag race someone. We also have no idea if John knew that Nick was drinking at the time he got into the car with him.
Also, from what I read, John had recently returned from Iraq. He earned several medals and apparently was a very good Marine. Since Nick was only 16 or barely 17 when this happened, he couldn't have been driving very long and John probably hadn't driven with Nick very often, so he very well may not been aware of Nicks bad driving habits.
No one is a bigger advocate for seat belts than me. I won't move my car until everyone in my car has their seat belts buckled. My cousins 3 year old son was paralyzed from the chest down in a car accident because he wasn't properly restrained, so I know what can happen. However, John not wearing a seat belt (which I have not seen officially confirmed) does not lessen the horrible mistakes Nick made.

Nick is absolutely responsible for the accident... but...
I know the kid doesn't deserve to be a vegetable because of one bad choice, but he did make the choice to ride in an incredibly fast car, driven by a drunk kid with every intention to speed/drag race, and chose not to wear a seatbelt. Obviously Nick is totally in the wrong, but choices were also made by the other guy, and its obvious that choice came with a big risk.
To me, its not just going home with a strange guy, but its analogous to going home with a strange guy whom you know has taken Viagra and has told you he wants to have sex. No, that doesn't mean you deserved to be raped, but it would be naive to think there isn't a chance of that happening.

and for the record... I wasn't comparing the crime of rape with the crime of vehicular damn-near manslaughter. I was comparing the argument that if a guy gets into a car with a drunk driver he is as much at fault because he knew of the risk to the argument that if a girl goes home with a stranger(thanks M.E. for clarifying) she is equally to blame if he hurts her because she knew of the risk. Again, not comparing the actions, comparing the arguments.

I think you're right. I'm trying to rack my brain from my civil procedure class: I think that even though this was a criminal trial, the Grazianos can try to pull something called "issue preclusion". Basically, if legal issue has already been litigated/decided in the previous trial (ie Nick's responsibility), the Grazianos can issue preclude Nick from re-arguing his responsibility in the crash at the civil trial.
I'm pretty sure you can use an issue finding from a criminal trial in a civil trial (because the burden of proof is beyond a reasonable doubt in criminal trials). It doesn't work the reverse way (civil to criminal), since civil trials have a lower burden of proof and a fact finding from a civil trial wouldn't satisfy a subsequent criminal trial.
Just my piece of nerd info. I guess the Hogan/Bolleas have already resigned themselves to admitting guilt for the criminal trial and liability for the civil trial. They've probably realized they gotta pay this kid's medical expenses for life.

Here's what I don't get at ALL:
Doctors had to remove part of Graziano's brain. His attorneys say Graziano still remains semi-conscious in the hospital and will need care for the rest of his life.
John Graziano's father, Ed, recommended a year of jail time. His mother, Debbie, wanted at least six months.
