It's DJ AM's Turn To Sue
Travis Barker already filed a lawsuit against people he claims were at fault for the plane crash that left with him burns and killed two of his friends. DJ AM has followed his lead and filed his own lawsuit in Los Angeles yesterday.
TMZ says DJ AM is suing the estates of the two pilots who died in the crash as well as Clay Lacy Aviation, Global Exec Aviation, Inter Travel & Services Inc, Goodyear Tire and Rubber Co, and Learjet.
In his lawsuit, DJ AM claims when the pilots reached takeoff speed, they knew shit was going down after one of the tires blew out. Instead of taking off, the pilots decided to quit the takeoff, causing the plane to crash and burst into flames. The suit says this was a bad decision made by the pilots.
DJ AM wants cash money for pain, suffering, lost earnings, property damage, punitive damages and past and future health-related expenses. Shit. I got tired just typing all that shit he's suing for.
Damn. I can understand suing companies and shit, but suing the estates of the pilots? I wonder if the pilots left behind any kids that need food, clothes and a roof over their heads. It seems a little extreme to try to fuck with the families, but I don't know the details and shit, so I will leave it at that.

I'm sure pilots have to have some major insurance, so it is very unlikely that money will be paid out of pocket. I work for a personal injury attorney, and suing for pain, suffering, lost earnings, property damage, punitive damages and past and future health-related expenses is pretty much standard. This happens all the time, and people need to realize that DJ AM is a victim here, too. He has been through a lot, and he deserves compensation. Again, the insurance company will be paying, not the family. Yes, there are rare exceptions, but this is likely not one of them.
He and Travis Barker should both just be happy to be alive and relatively well...both the pilot and co-pilot lost their lives, as did the other passengers on the plane. Even if the crash was a result of pilot error, these two dumb fucks have probably got more money than the pilots' families have.
To think I actually felt for these two after the crash and was happy to hear they were recovering...they really are a waste of space.
I have absolutely zero-sympathy for him after reading that article. Going after companies is one thing, but the families of the DEAD pilots? What a fucking asshole. Those families lost their loved ones too, and they don't have millions of dollars to fall back on like AM and Barker. What a complete grinch and douchebag.

Poor girl didn't have any help driving and I don't know how far she had to drive but I'm in GA and for me at 29, it's getting to be where if I drive to Orlando I would fall asleep without help. So, If i was alone which I never am, I would have to stop. That's so wrong in that case, the other people were drunk and it should have been said that they were partially at fault for not helping her drive all that way...they were irresponsible and got drunk.

I had a co-worker who had a teenage daughter that drove a SUV of her friends to Orlando, when they drove back everyone was shit faced but her - not one drop. She drove, and fell asleep at the wheel and crashed on I-4 here. My co-workers daughter died, two passengers died and two lived. All of them sued her mom who lived in a trailer with a small son and the insurance only paid out like 10K. She owes millions to the families. She didn't even have money to get a gravestone for her daughter, her daughters employer (a dentist) bought one like a year after she died.

Like I said, considering anyone is alive and the pilots are dead, the pilots put the people first, they are supposed to and they did their job I think so this lawsuit shouldn't even be a go. DJ AM and whoever else suing the pilots I guess don't have a guilty conscience. They need to read up on what pilots go through with training and stuff.

Madam Pince, I agree with you. The pilots were doing their best. Their families are missing loved ones this holiday too. If someone is flying a plane while drunk or high, then I can see going after them. But that was not the case.

I apologize in advance for my rant. I'm just really pissed off.
Pilots, in general, take the safety of their passengers & crew very seriously, as well as those below their flight path. Al Haynes, who along with his crew crash-landed a DC-10 in an Iowa cornfield in 1989 after the plane's hydraulics failed, was credited with saving the lives of 185 passengers, although he never forgot the 112 who died in the crash. He was recorded on the plane's black box as telling air traffic controllers to keep the plane away from Sioux City. Several survivors were so grateful to Haynes that, in tribute, they flew on his retirement flight in 1991.
The only Concorde to crash, Air France Flight 4590, blew a tire & caught fire as it was taking off from Charles de Gaulle Airport in 2000. Although the plane ultimately crashed into a nearby hotel, the crew was trying to divert to a nearby airport for landing (which was later judged impossible given the damage) and were seen by those under its flight path fighting to keep the plane from crashing in a populated area.
Not to mention the 9/11 pilots who keyed their mikes on so air traffic controllers could hear the hijackers, even though they knew they were headed for their own deaths.
Shit happens. The pilots made an impossible decision. Barker & AM survived. Go on with the lives you're supposed grateful for and leave the families to grieve without being sued.

Cases like this take many months before anyone really has any idea what actually went wrong and what might have been done differently.

But according to this article, I guess the FAA stopped recommending them back in 1987, due to overshooting the runway and messing with planes breaks. So maybe the pilots thought the likelihood of a foam landing was nil to non-existant?

Just to play devil's advocate--I don't think anyone should have sued the pilots--I guess the plaintiffs would argue that, once airborne, the pilots could arrange a foam landing, with fire trucks and rescuers standing by. I know that's plenty risky, too, but most lawsuits are decided in hindsight.
This "sue everybody in sight" mentality pisses me off. First, DJ AM & Travis Barker have more money than those pilots ever did. Second, as MK so wisely pointed out, these two jerks are taking money from kids and widows. I don't care if including the pilots' estates is just a legal ploy -- it's a greedy move.
I'm not a pilot, so I can't speak definitively, but it seems that when the tire blew out, the pilots had nothing but negative options: try to take off or abort. They made the best decision they could -- who knows what would have happened if they'd tried to take off? They might have crashed in a neighborhood and caused even more damage & deaths.
I won't contest that Barker & AM are entitled to lifelong medical care for their injuries, but the other stuff? Suck it up, assholes. I thought y'all were grateful to be alive. Sounds like they're just glad they have access to the American legal system.

If he has any brains, he has private health insurance that already covers his medical care. He might be out the deductible and that's it. My guess is no punitive damages here--certainly not against the pilots and only against the other defendants if he can show they intentionally operated an unsafe plane.
This guy is an ass, good lawyers or not, obviously he is sue happy, WAY too sue happy with the link just posted about him suing a paper too, you can't tell me he just has bad luck all the time. I think that is his other career, to sue people.

If he's suing them in CA, it's probably because he has a better case against the aviation firms, etc. if he can proof that their employees were negligent, etc. Most likely the aviation firm will be compelled to pay for the pilots' estate's representation. Further, if he has a good case, then the settlement deal will probably include some kind of release of liability for the pilots' estates. the pilot's family will probably not even be involved and their attorneys will explain this to them anyway. AND the aviation firms have insurance to cover this anyway. It'll never get to court and this is just a legal maneuver. It's a crap situation, but that's how the law works. AM isn't a cold-hearted jerk, he just has good attorneys.

Well, I don't like DJ AM at all, but actually, INS companies always deserve to pay in my opinion. They rack up money all day everyday and anytime they have to pay is good to me. I sound so bitter, but I am bitter against billion dollar companies, most of them. I'm not jealous, I just don't like companies who get so much money everyday , usually they are evil. That's just the way I think.
As mentioned by other posters...any insurance companies among the defendants will likely bear the cost of a settlement.Probably won't even be a trial.
