It's DJ AM's Turn To Sue

Travis Barker already filed a lawsuit against people he claims were at fault for the plane crash that left with him burns and killed two of his friends. DJ AM has followed his lead and filed his own lawsuit in Los Angeles yesterday.

TMZ says DJ AM is suing the estates of the two pilots who died in the crash as well as Clay Lacy Aviation, Global Exec Aviation, Inter Travel & Services Inc, Goodyear Tire and Rubber Co, and Learjet.

In his lawsuit, DJ AM claims when the pilots reached takeoff speed, they knew shit was going down after one of the tires blew out. Instead of taking off, the pilots decided to quit the takeoff, causing the plane to crash and burst into flames. The suit says this was a bad decision made by the pilots.

DJ AM wants cash money for pain, suffering, lost earnings, property damage, punitive damages and past and future health-related expenses. Shit. I got tired just typing all that shit he's suing for.

Damn. I can understand suing companies and shit, but suing the estates of the pilots? I wonder if the pilots left behind any kids that need food, clothes and a roof over their heads. It seems a little extreme to try to fuck with the families, but I don't know the details and shit, so I will leave it at that.

As mentioned by other posters...any insurance companies among the defendants will likely bear the cost of a settlement.Probably won't even be a trial.

It's the "Deep Pocket" strategy used by their attorneys.Sue the widest group possible-and if there's a judgment-the entity with the most money pays most of the judgment.Usually crashes like this are related to pilot error...but what is the right call in a "bang bang" play like that? Tough one.Seems to me that if you're walking & functional after something like that...ah, modern life.

I hope it's only DJ AM suing, Travis talks too much about being greatful that I would thik he wouldn't sue the pilots. I don't care if Travis sues the tire company or whatever, though I think people are too sue happy. But, Travis seems too nice at least lately to mess with the dead pilots families....so I hope that's correct (for the person that said that it's not Travis).

I don't think DJ AM should have sued the pilots' estates, but he's unlikely to lose. He'll either get paid off by the corporate insurers, or go to a jury trial. In Cali, the injured person only has to show the defendant is partially at fault---even 5% at fault is enough. That's enough to make the defendant pay 100% of your economic losses (bills, lost income) and 5% of your pain and suffering. If the defendant is 40% at fault, the percentages become 100%/40%.

Jurors will feel sorry for the dead pilots and their heirs, but they'll also listen to DJ AM's testifying at length how horrible it was during the crash, how much his burns and treatment hurt, how much work he lost, etc. Jurors figure somebody's gotta pay and it might as well be the insurers, so they dole out money in a real accident.

Those two think you can change the tires in the air I guess. With there being a lawsuit at first I thought, how is that possible? What can they do, change them in the air? Is there a spare tired that pops out? I know better but I wondered if there is nothing for them to do, how can there be a lawsuit?

The pilots i'm sure did well, they are alive, if someone is alive from the plane i'm guessing the pilots did well. So the family has nothing to do with it, but if someone is alive on the plane I think the pilots did well too. That's assuming the tire was really just bad and the tires were checked before they left.

I'm sure DJ AM isn't as rich as say, paris hilton but what I guess that's his competition, he has to be as rich as the other hollywood people. If he doesn't have a Bentley then he's no one. So that's why he has to sue.

Suing families that had nothing to do with the circumstances of his accident seems pretty fucked up. They are suffering their own losses, you selfish dick. Any sympathy I had for these douchebags just evaporated.

Also, if I remember correctly (& I could be wrong) Barker did not include the estates, but his dead assistants WIDOW was the first one to do that, with AM following suit.

Hopefully, the dead pilots estate can sue the tire company etc also

You know what sucks too, even if it gets thrown out of court, doesn't the deceased pilots families need to hire lawyers to fight this? They will be draining any money that could go to the families on lawyers....

Tire compnay is accident to me too though, everyone sues too much...Don't get me wrong, I have done it....but it was with a hospital that was totally totally negligent....I don't really judge people who sue and am not saying don't sue but I am judging them for suing dead pilots...

Another thing, those poor families of the pilots are already dealing with not having them around for the holidays, let alone trying to survive without them financially and otherwise...why the heck would you sue them now, just to make things worse for their families?

I agree with the others here who said that it was probably wiser to abort takeoff than fly and have to eventually land with a blown tire.
They made a split second decision, in the face of death, and he's suing them for not making a better decision (and there probably wasn't a better decision to be made)? What an a$$. The sense of entitlement of these wanna-be celebrities is embarrassing.

He should be thankful he is even alive.

Forgive me because I don't know the details but, what ever happened to accidents? Suing the pilots that pretty much saved your life by "crashing" the plane in a way were they could probably save the passengers? Come on man I'm sure you have more than enough money, not to mention your LIFE.

Holy shit. You're what they call a survivor. People like you tend to go on to live productive and full lives so good on you. And do not lose faith use of the arm will come back. So many people have had rehabilitation and it takes a long time and is so painful but in the end it pays off.

Suing a faceless corporation ain't a shocker, we are a litigious society. But involving the grieving families of the dead (via their estates) is all the info I think we need.

So much for near death experiences changing someone and giving one gratitude.

This makes me dislike him and it's a shame the families of the dead pilots are getting hit with this right before Christmas. Fuck AM. Karma's pimp hand is strong though so it'll all get sorted out in the end.

I love how the lawsuit blithely states " the pilots made a bad decision'". Well, in a crisis life or death situation I'm absolutely sure they made what they believed was the best decision for all of them. You think the pilots wanted to risk their lives and die? No. They did what they could and it failed. It's called an accident, A.M.

He needs to learn life cannot be controlled and lawsuits are laughable in the face of it all.

I so agree with you, Michael. At least these clowns have their LIVES, which is something the pilots DON'T have! What heartache this is most likely causing the families left behind. :(

And I'm the same way - I've never been in a really bad accident but I've been in minor ones and people HAVE accidentally screwed me over. At the end of the day, I'd rather do my best to spread some joyful energy after something terrible happens than make it worse by getting all blamey and looking for vengeance.

You know what I said: Thank God I have great insurance, if not, the most I would have requested would be for those bills to be covered. The calls and letters of apology and fruit basket they sent were more than fine. It was an accident for pete's sakes!!
Why can't people just be decent human beings? Why do they have to make a buck at someone else's expense?
Sorry, for the long winded rant. But this crap really pisses me off!

He HAS to sue the pilots or the big ass companies will point the finger at the pilots if they are not named in the suit and the case will be dismissed. That is how these suits work, you name everyone involved then eliminate. I worked for lawyers that sued large corporations like this.

Yup. Don't matter. It's even worse than that: if they get a fat judgment, they could collect on pretty much whatever's in the estate. Cases like this tend to settle after a year or so of mucking around. The corporate insurers pay up to make it disappear and avoid the risk of trial. My wildass guess would be a $3m settlement for each plaintiff?
