Gold Digger vs. Gold Digger
Dennis Hopper filed for divorce from his wife of 13 years, Victoria Hopper, a couple of weeks ago, even though he is reportedly on his deathbed. One of Dennis' friends said that he was only divorcing his wife to keep her from getting a large chunk of his money when he passes away. Victoria filed her own legal papers today, requesting custody of their 6-year-old daughter Galen (Fun fact: Galen was one of my nicknames in junior high).
In papers obtained by the Daily Beast, Victoria says she wants spousal and child support. Victoria also thinks that the court should name her and Galen the equal beneficiaries of Dennis' $1 million life insurance policy. Victoria explains, “Based on Petitioner’s statements to me that he will leave me destitute and because I do not have a steady or significant source of income, I fear I will be unable to financially provide for our six year old daughter and myself.” But Victoria didn't stop there!
Victoria says that Dennis, who is currently battling prostate cancer, regularly smokes medical marijuana in front of their daughter. That actually is a form of HUMAN ABUSE, because you shouldn't smoke a joint in front of a person without sharing!
The Uma Thurman/Toni Collette hybrid claims that Dennis has threatened to kill her ass if she leaves him, and that he keeps loaded guns in the house. AND THERE'S MORE!
According to Victoria, Dennis doesn't want to divorce her. Victoria believes that his 47-year-old gold digging daughter is making Dennis go through with the divorce, so she can get a bigger cut of his fortune when he dies.
Who knew the end of a marriage could be like a 4-episode story arch on Dynasty? SIGN ME UP! The only way this could get more dramatic is if Galen runs away to marry the Prince of Moldavia. And P.S. - The King of Moldavia's name is Galen. This is all connected somehow.

I dont have anything clever to say, yep like usual, but I will say that if there is no prenup and no will she gets at least half.....even if there is a will she cannot be completely disinherited unless the testator's failure to provide for the spouse in the will was intentional and that intention is apparent in the will (and being sick before death with a gold digging child is frowned upon if there is not a good reason and it will be challenged) .
The more that I look at this I say, again.... dad is full of drugs and one of his kids is taking advantage. I have a stepmother I may not love, but she has taken care of my dad for 10 years.... as much as I would like to think she has not been great to the fam, she deserves part of the fortune(150 dollars total) if he dies (which will nevert happen -- my daddyo will live forever), she deserves a part of the 150 dollars, she has dealt with him for his elder years. I am thinking at this point his will leaves everything to her and her daughter and family is working to get him divorced before he dies. (changing the will will be subject to even more scrutiny because of the drugs and in trust and estates, being of not sound mind may be easier to reverse than divorcing while on drugs). I have seen plenty of poeple taken advantage of when they are sick and are about to die and this story breaks my heart.

She was left assets; she wasn't cut out, but that was not enough for her. She contested the will and got EVERY PENNY. Those kids were left with NOTHING. It happens, just sayin'...

"It depends" is the classic answer, but here's what I think and our law ho's can chime in...I think the marriage contract comes before the will unless the will was part of a prenup. A marriage is a forging of assets as well as a promise not to fuck others so unless you have a legally binding contract (prenup) that changes that "merger", your spouse will inherit the bulk of your marital assets and otherwise (meaning everything) unless it's SPECIFICALLY designated in your will (meaning they can still get the marital assets...ALL of it just what's not marital assets). As for the assets OUTSIDE of the marriage, every penny of it can be willed to someone else, anyone else, but that has to be in a legal document form and even if it is, the spouse can contest the will on certain grounds and even prevail.

If they are legally married, it's not that easy. Marriage is a legally binding contract. Once you've signed a contract, you've basically signed your "but that's not what I want now" rights away. You have to get out of said contract in order to get what you want unless the other party legally agrees to forfeit all rights to that contract and that happens as often as hell freezes over.

I agree that it's pretty shitty to simply exist as the spouse of a celebrity, and then think the money they earn is by default yours... but as far as I'm concerned I think she deserves the money a hell of a lot more than any of his adult children. I mean, she was married to him for 13 years, put up with any and all of his crap during that time, made life decisions with him, and had his kid. I doubt his adult children were tending to his needs over the last decade or so.

I don't think this janked up divorce action is going to happen because I think she can (and with good reason) stall it enough to prevail OR challenge the whole mass fuckery after the fact due to the Denster not being of sound mind (hence the introduction of DA DRUGS into the whole mess). In the end, she's likely to either prevail or come out with a good chunk o' change...and depending on the Hoppster's state of mind, who's to say she shouldn't?
