I thought it was established that Halle paid the nanny to say those things about Gabriel. The only thing that is clear about last week is that Olivier beat Gabe so bad that he broke his own hand. No evidence of Gabe hitting Ollie is available. And being in foster homes in no way means he is unable to control his behavior. Anyone can be put in foster care through absolutely no fault of their own. In fact, most are placed in foster care because they have been abused and neglected by their parents, not because the kids did anything wrong at all.

I agree with Mickey Holland here. I think it's only a matter of time before Halle puts the crazy in her relationship with Olivier. Why would her relationship w/him be any different than all of her past relationships? It's really unfortunate that all of this went down in front of the kid. I would bet that Olivier and Halle know how to push all of Aubrey's buttons & they did just that on Thanksgiving day. Unfortunately, Aubrey should know better by now, but he seems to fall for it every time. Personally, the fact that he got into a physical altercation w/his ex's latest piece does not make him a bad father & I don't think he should lose visitation of his kid. What they should have done a long time ago is set up pick up and drop off of the kid at a neutral court appointed location.

@ Mrs_Fox, I think the mainstream public sees her as a mom protecting her child, and they buy all the press releases by Halle's agents to make Aubry look bad, whether warranted or not. Every headline reported Aubry being arrested and really buried the citizen's part, for example People.com's headline "Halle Berry's ex-boyfriend Gabriel Abury arrested after Thanksgiving brawl" they then write about how witnesses saw Aubry start things and throw a punch and "Police were called and luckily Martinez had control of the situation enough to make a citizen's arrest for battery against Aubry." How lucky for Halle and everyone that a citizen's arrest was able to be made even when police were there and could make their own regular arrest but didn't! Obviously she has the better PR team. I think it's more of a dlisted thing to actually think she's a bit crazy and perhaps has another agenda. What most other people think is just that she's crazy hot.

I don't think Halle is a stupid woman, so why is she prepared to destroy both her career and her public image in an effort to get this man away from her child? She's doing a bit too much for simply disliking him so I'm guessing more is happening behind the scenes.

"Citizen" just means not a cop; you don't have to be a legal citizen of wherever the arrest takes place. If you did, people would get away with murder on foreigners.

That copy-and-paste section you posted doesn't include the definition of a private person. I'm pretty sure I've seen it specified elsewhere in the law that such a person must be a citizen. (That's sort of the whole thing with a citizen's arrest.)

Nevermind the fact that there still is zero evidence Gabriel instigated the fight -- that's Halle and Olivier's word against Gabriel's. And there also is zero physical evidence that Gabriel did anything, with the injuries to Olivier's hand proving only that he pounded the fuck out of Gabriel's face.

whether aubry was unlawfully detained by martinez is an issue to be resolved by a civil court judge, not part of the standard for the family court restraining order.

here are the CA penal code sections for citizen arrests. where does it say one has to be a citizen of the US or a citizen of CA to make a citizens' arrest?

837. A private person may arrest another:

For a public offense committed or attempted in his/her presence.
When the person arrested has committed a felony, although not in his presence.
When a felony has been in fact committed, and he or she has reasonable cause for believing the person arrested to have committed it.

839. Any person making an arrest may orally summon as many persons as he/she deems necessary to aid him/her therein.

841. The person making the arrest must inform the person to be arrested of the intention to arrest him, of the cause of the arrest, and the authority to make it, except when the person making the arrest has reasonable cause to believe that the person to be arrested is actually engaged in the commission of or an attempt to commit an offense, or the person to be arrested is pursued immediately after its commission, or after an escape. The person making the arrest must, on request of the person he is arresting, inform the latter of the offense for which he is being arrested.

It seems like Gabriel's attorneys should be able to argue a few points, including:

o Unless there's video and audio, this is Olivier and Halle's word against Gabriel's -- and as people have noted, Gabriel just won a key custody battle in court. Right now this very much looks like Halle and Olivier are the ones with 100 percent motivation to instigate harassment of Gabriel and the attack on him. Right now not only is there zero proof that Gabriel instigated the fight, there also is zero physical evidence against Gabriel -- the injuries to Olivier's hand proves only that Olivier punched the fuck out of Gabriel's face.

o Which leads to a second really odd legal situation: Olivier did a "citizen's arrest" of Gabriel. Nevermind the fact that it's legally questionable whether he even can do that (he's not a U.S. citizen, is he?) -- and the possibility that Gabriel's attorneys will argue he was unlawfully detained by Olivier and Halle -- but this "citizen's arrest" in itself is ripe for use as part of a legal argument that Halle and Olivier are harassing Gabriel for his recent court victory.

And then there's that heck of a brutal punch Olivier landed on Gabriel. That goes to the same legal argument that they're harassing him to the point of literally attacking him.

I hope Gabriel's attorneys are out for blood.

i think bitch will get the restraining order for herself and her residence and martinez and his residence, but it will not be a permanent order vis a vis nahla. under these facts i don't think the court will deny aubry all custodial rights re nahla. maybe will order that exchanges of child have to be made in neutral place not a parent's home (family court has people/places under contract to provide those services). maybe nahla's time with him will need to be supervised by 3rd party service provider for a while.

HotMami - it is so, so sad and I think that's why people get so worked up about it. She has no basis, realistically, to get full physical custody, but I am sure as in the past three years she will continue to manufacture incidents where he will be dragged before a judge every few months with fear of losing his child, even if her incidents results in broken bones etc. She doesn't give a shit and is probably swimming in glee that Gabriel will ikely miss his Spring Campaigns now. Then she can send more info to TMZ about how she has the most money etc. etc.
